Terms of Service

These Terms of Service ("Terms") govern your use of the getvik digital marketplace. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you should not use getvik.

Definitions

• Platform means getvik.
• Creator means the seller on getvik.
• User means any person using getvik, including buyers and creators.

1. Acceptance

By creating an account, accessing, or using getvik, you confirm that:

• You are at least 18 years old.
• You are capable of entering into a binding agreement under applicable law.
• You agree to these Terms and our Privacy Policy.

2. Accounts & Registration

To use certain features such as buying or selling products, you must create an account and provide accurate information. You are responsible for:

• Keeping your login details secure.
• All activity that occurs under your account.
• Informing us promptly at support@getvik.com if you suspect unauthorized access.

Creators must provide PAN details (Permanent Account Number) to receive payouts. Payouts will be blocked until a valid PAN is provided.

3. Listings & Content

getvik allows creators to list and sell digital products, for example files, assets, templates, or courses. As a creator:

• You are responsible for the accuracy of your product descriptions, pricing, and any claims you make.
• You must own or have the necessary rights to all content you upload and sell.
• You must not list or distribute content that is pirated, infringing, deceptive, illegal, or harmful.
• You must not publish low-effort AI-generated slop or otherwise low-effort content that does not meet reasonable marketplace quality standards.

We may remove or restrict any listing or content that, in our reasonable opinion, violates these Terms, the law, or someone else's rights, or creates risk for users or getvik.

To protect buyers and creators, getvik may remove low-effort AI-generated and other low-effort content, and may take related moderation action on associated listings or accounts where appropriate.

We may review product files (using both automated systems and manual inspection) to ensure quality, prevent fraud, and verify compliance with our platform policies.

4. Payments & Fees

getvik provides payment processing, transaction facilitation, settlement infrastructure, and marketplace tools that enable transactions between creators and buyers. While the underlying transaction for the purchase of any product is between the buyer and the creator, getvik reserves the right to manage payment processing, withhold payout settlements for fraud mitigation, and resolve buyer disputes, acting reasonably and in accordance with platform policies. We support international payments via PayPal. By selling globally, you agree that payouts may be subject to payment gateway fees (including PayPal fees), currency conversion charges, and our platform commission (10%). These charges are deducted before payout. Additionally, payment providers may impose temporary holds, reserves, or delays on transactions, which can affect payout timelines. We are not responsible for such delays.

4.1 Refund & Chargeback Policy

Because digital products are downloadable and instantly consumable, all sales are generally final and non-refundable, unless required by applicable law. However, to maintain high marketplace trust, getvik may process refunds, acting reasonably and in accordance with platform policies, under the following circumstances:

• Duplicate purchases of the same product within a 24-hour window.
• Major technical defects where the files are demonstrably corrupted or completely inaccessible.
• Explicitly deceptive product descriptions or gross misrepresentation.

getvik reserves the right, acting reasonably, to review refund requests, mediate disputes between buyers and creators, and deduct refunded amounts from the creator's settled or pending balance. In the event of a payment chargeback or dispute raised by a buyer through a bank or payment processor, the creator is responsible for cooperating fully and shall bear any associated dispute or chargeback processing fees.

• Sales vs. Settlements: A "Sale" occurs when a buyer completes payment. However, funds are only credited to your creator balance once "Settlement" is confirmed by the payment provider (usually within 24 hours of the sale).
• Payout Eligibility: Creators receive payouts after deductions for platform fees (10%), affiliate commissions (if applicable), and payment gateway processing fees.
• Fund Holding: To protect our marketplace community from fraud and simplify refund requests, we maintain a 2–3 day temporary payout hold on settled funds. getvik is not a bank, wallet, or escrow service; these funds are held temporarily for operational security.
• Fees: All fees are calculated based on the net amount received from our payment gateways. Global payments via PayPal may involve additional currency conversion charges.

Creators are solely responsible for their own taxes. getvik does not collect or remit taxes on behalf of creators at this time, except where required by law (e.g., TDS).

5. Prohibited Conduct

When using getvik, you must not list, sell, or distribute content that contains:

• Pirated software, cracked license keys, unauthorized copies, or stolen digital assets.
• Malware, viruses, ransomware, trojans, spyware, or malicious code designed to disrupt, track, or damage systems.
• Sexually explicit, pornographic, hateful, or highly offensive material.
• Financial scams, get-rich-quick schemes, or multi-level marketing (MLM) promotions.
• Impersonation of any individual, group, brand, or platform.
• Materials violating trade sanctions, export laws, or regulations governing prohibited substances and weapons.

Additionally, all users are prohibited from:

• Engaging in fraud, payment abuse, or chargeback manipulation.
• Attempting to bypass getvik's platform fees or redirecting transactions off-platform.
• Using spammy, deceptive, or low-effort tactics (including low-quality AI-generated slop) to manipulate visibility, search results, or reviews.
• Attempting to scrape, disrupt, or hack getvik's technology or services.

6. Intellectual Property

You retain ownership of the content you create and upload to getvik. By listing or uploading content, you grant getvik a non-exclusive, worldwide license to host, store, display, and deliver your content as necessary to operate the platform.

If you believe your intellectual property or copyright has been infringed on getvik, please send a formal copyright infringement notice to our designated copyright agent at support@getvik.com. Your notice must include:

• A physical or electronic signature of the copyright owner or authorized representative.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the infringing material with specific URLs on getvik.
• Your contact information (name, address, email, and telephone number).
• A good faith statement that the disputed use is not authorized by the copyright owner.
• A statement under penalty of perjury that the information provided is accurate and that you own the copyright or are authorized to act on behalf of the owner.

Repeat Infringer Policy: Accounts found to have repeatedly infringed third-party copyrights or intellectual property rights will be permanently suspended, and their associated listings and balances removed without liability or refund of platform fees.

7. Privacy

Our handling of personal data is described in the getvik Privacy Policy. By using the platform, you consent to the collection and use of your information as described there.

8. Suspension & Termination

We may suspend or terminate your access to getvik if we believe that:

• You have violated these Terms or our policies.
• You are involved in fraud, abuse, or illegal activity.
• We are required to do so by law, regulation, or court order.

Termination may result in removal of your listings and restricted access to your account. Termination does not cancel obligations that reasonably survive.

9. Disclaimers

getvik is provided on an "as is" and "as available" basis. We do not make any promises that:

• The service will be uninterrupted, secure, or error-free.
• All listings or content will be accurate, complete, or suitable for your specific needs.

To the fullest extent permitted by law, we disclaim all warranties.

10. Limitation of Liability

To the maximum extent permitted by law, getvik will not be liable for:

• Indirect, incidental, special, punitive, or consequential damages.
• Loss of profits, revenue, data, or goodwill arising from your use of the platform.

Where our liability cannot be excluded, it is limited to the maximum of either: (a) the total amount you actually paid to getvik during the 12 months immediately before the event giving rise to the claim, or (b) ₹5,000 (five thousand Indian Rupees), whichever is higher, except where such liability limitation is prohibited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless getvik from and against any claims, losses, or expenses arising out of:

• Your use of the platform.
• Your listings, products, or content.
• Your violation of these Terms or applicable law.
• Your infringement of any third party's rights.

12. Payment Security & Disputes

Payment processing and chargebacks are handled according to the rules of the payment gateways and banks involved. If a dispute or chargeback occurs, creators are expected to cooperate by providing accurate information.

We reserve the right to hold or reverse payouts if we suspect fraud, abuse, policy violations, or payment disputes related to a transaction.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts in Uttar Pradesh, India, unless applicable law requires otherwise.

14. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and may provide additional notice. Your continued use of getvik after changes take effect constitutes your acceptance of the updated Terms.

15. Third-party Services

getvik may link to or integrate with third-party services such as payment gateways or analytics tools. We are not responsible for those third parties, their terms, or their actions.

16. Miscellaneous

• If any part of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
• These Terms, together with our Privacy Policy and any creator or platform-specific agreements, form the entire agreement between you and getvik.
